QIOS Pelican - End-User License Agreement (EULA)

THIS END-USER LICENSE AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL, COMPANY OR AN OTHER ENTITY) AND QIOS B.V. (QIOS). READ IT CAREFULLY BEFORE COMPLETING THE INSTALLATION PROCESS AND USING THE SOFTWARE. IT PROVIDES A LICENSE TO USE THE SOFTWARE AND CONTAINS WARRANTY INFORMATION AND LIABILITY DISCLAIMERS. BY INSTALLING AND USING THE SOFTWARE, YOU ARE CONFIRMING YOUR ACCEPTANCE OF THE SOFTWARE AND AGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT.

DO NOT INSTALL THIS SOFTWARE AND ITS ENCLOSED SOURCES IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF THIS END-USER LICENSE AGREEMENT.

This software is distributed "AS IS". The End-User only is responsible for installing and using this software.

Your license rights under this EULA are non-exclusive and provide the right to use the product. A valid license under this EULA will in no way result in any ownership of the software or any part of it. The product in this package (software, code, examples and other sources) is proprietary to QIOS and is protected by Copyright and Trademark laws.

YOU ARE NOT ALLOWED TO ABUSE OUR SOFTWARE OR ANY RELATED PARTS OF IT TO DISTRIBUTE UNSOLICITED (COMMERCIAL or NON-COMMERCIAL) E-MAIL, ALSO KNOWN AS SPAM, OR TO DISTRIBUTE COMPUTER VIRUSSES OR ANY OTHER COMPONENT OR PIECE OF SOFTWARE THAT HAS THE INTENTION TO DISTURB OR HARM THE NORMAL OPERATION OF COMPUTERS, SOFTWARE, NETWORKS OR THE INTERNET. Technological measures are built in to be able to track down senders of such e-mail. You agree that QIOS is allowed to apply and to use those measures.

You may not alter, merge, modify, adapt or translate the product, or decompile, reverse engineer, disassemble, or otherwise reduce the product to a human-perceivable form. You may not rent, lease, or sub-license the product or otherwise make it available to others.

You may not make or distribute copies of the product, or electronically transfer the product from one computer to another or over a network. You may not alter, merge, modify, adapt or translate the product, or decompile, reverse engineer, disassemble, or otherwise reduce the product to a human-perceivable form. You may not rent, lease, or sub-license the product or otherwise make it available to others.

QIOS and/or its employees are never liable for damages caused by using this software, loss of data, loss of use, lost profits or revenue, missed savings or for any indirect or consequential damages of any kind whatsoever. QIOS does not state that its software, Internet site, Extranet or other sources is arranged or is specially usable for the application aimed by the user.

Errors, interruptions of service or delays may occur at any time. QIOS is not responsible for damage caused by failure of power or failure in communications, equipment, hardware or software, regardless if these are manufactured, supplied, maintained or managed by QIOS or a third party, nor for other causes by which lost or delayed use of QIOS software, webservices, website(s), database(s) or other linked facilities of QIOS or third parties, is caused. The user is aware of the fact that the Internet is not always (directly) available, and as a result can not be seen as a completely reliable medium of communication. QIOS is not responsible for damage as a result of computer viruses or other sources which aim to disturb or influence the normal and correct functioning of software and/or equipment.

To all agreements or succeeding agreements with QIOS the general conditions of ICT~Office apply. A copy of these general conditions will be provided on first request, free of charge.

THE TERMS OF THIS LICENSE AS WELL AS THE PRODUCTS' INTERFACE DESIGN, METHODS, PROPERTIES, FILE FORMATS, ENCLOSED SOURCES AND HELP FILES ARE SUBJECTS OF CHANGES IN UPDATES AND FUTURE VERSIONS OF THIS PRODUCT.
